Telephone Consumer Protection Act (TCPA) Compliance
TCPA (Telephone Consumer Protection Act) protects the privacy rights of individuals by restricting the use of telephone equipment.
Section (b)(2)(F) provides special allowances for:
“tax-exempt nonprofit organizations to send unsolicited advertisements* to their members** in furtherance of the association’s tax-exempt purpose.”
*Text messages, emails, and phone calls
**Donors, supporters, and constituents
For-profit organizations must receive “expressed written consent” before sending advertisements.
The following apply:
– Carriers are not liable for delayed or undelivered messages.
– Message frequency may vary but you will receive no more than 4 messages per month
– You can get help with any campaign at any time by texting “HELP” to the relevant short code
– You can opt-out or stop a campaign at any time by texting “STOP” to the relevant short code.

Cell Phone Carrier Compliance
MMA (Mobile Marketing Association) best practices are required by all cell phone carriers for text messaging programs.
Section 1.4-9 states that after a mobile number has been added to a list, a confirmation text message must be sent the to the subscriber containing the following information:
